What would happen to my Will if I were separated but not yet divorced?
If you have separated from your spouse but not yet finalised the divorce, you are still legally married and therefore any Will remains valid. It is vital that your Will is updated to reflect your wishes throughout this transitional period and beyond. Essentially, if your Will was written pre-separation, are you still wanting your spouse to benefit from your estate in the same capacity? If you do not have a valid Will, your spouse will still be entitled to inherit from you, this is called the intestacy rule.
What happens to my Will after my divorce is finalised?
Divorce does not revoke a Will. It remains valid; however, your ex-partner is treated as though they died when the divorce was finalised. If your Will does not stipulate what happens in the event of your ex-partners death then the rules of intestacy come into play, meaning your estate may be divided against your wishes. This may jeopardise any inheritance you had planned for the rest of your family and mean that new partners or dependents aren’t provided for.
Making a new Will can also help prevent potential claims from being brought against your Estate under the Inheritance Act. In some cases, an ex-spouse can make a claim for financial provision, but having an up-to-date Will can help plan to try and prevent a claim from being successful.
